Do you Own a Hair & Beauty Salon or Retail Outlet in Australia? – It’s your turn!

On 4th April 2017, the Acting Fair Work Ombudsman Michael Campbell announced that Fair Work Inspectors will conduct audits of at least 1600 Hair and beauty salons and retail businesses in randomly selected urban and regional areas of Queensland, New South Wales and Victoria.

The first phase of these audits is already underway as I write this, and these businesses will continue to be targeted through til early-mid 2017.

The last auditing campaign targeting salon operators nationally in 2013, identified a staggering overall industry non-compliance rate of 55 per cent, with Victoria recording the highest rate of non-compliance with almost three quarters of salon operators audited not meeting their obligations under workplace laws.

The previous Fair Work Ombudsman national auditing campaign of the retail industry (in 2012) found non-compliance with workplace laws to also be widespread with more than 40 per cent of underpayment breaches alone being owed by NSW employers.

"This new hair, beauty and retail campaign will build on our previous work to reinforce the need for all workplace participants to proactively ensure they are meeting their obligations under Australian workplace laws," Mr Campbell said.

What will they audit?

Without getting in to too much detail here, the obligations you need to check you comply with fall into following categories:

  • National Employment Standards (NES)
  • Leave entitlements
  • Pay & conditions
  • Time & wages records
  • Dismissal & bargaining
Feeling unsure whether you're compliant?

If you are unsure whether your current employment practices meet your obligations under Australian workplace laws, it would definitely be a good time to find out for sure. If you don't have the time to trawl through the Fair Work Act yourself and interpret the legal-speak, then you will need some assistance from a professional in the HR employment law field.

HR Tactics works with SME's across all areas of HR, and compliance is one of those areas. We can assess your level of compliance across all the categories listed above and advise you on the changes you need to make to ensure you're no longer legally exposed.
